Construction Claims and Responses. Effective Writing and Presentation Construction Claims and Responses. Effective Writing and Presentation

Featuring a Foreword by Roger Knowles FRICS, FCIArb, FQSi, Barrister The book discusses the different types of claim common to construction contracts and presents a step-by-step guide which demonstrates the process of building up the submission of a claim. It includes guidelines as to how to set out the claim, section by section in a logical manner to ensure that the essentials of a successful claim are included. Worked examples of claims for variations, extensions of time and additional payment are included together with sample wording showing precisely how the claim may be presented in a manner which will lead the reviewer to a logical conclusion – or at least contain a persuasive argument to support the claimant’s case. The vast majority of claims are managed without the need to resort to case law or legal matters. Construction Claims: effective writing & responses therefore discusses what the claim is trying to achieve and how to do this in a logical and persuasive manner This is a practical, hands-on guide for the construction industry professional which explains how to approach the preparation of the claim document, what topics to cover, how to present the essential elements and how to compile the submission document into a user friendly and comprehensive document. For those whose job it is to review such submissions, it advises how to prepare responses which set out the respondent’s counter arguments, points of view and determinations. The guide covers: The various types of claim. How the claim may be split into sections dealing with the details of the contract, the cause, the effect, entitlement and quantum. What this section is attempting to demonstrate or achieve and why. What should be included within the section and why. Worked examples of typical claims and responses with sample wording.

Drought and Aquatic Ecosystems. Effects and Responses Drought and Aquatic Ecosystems. Effects and Responses

Droughts are a major hazard to both natural and human-dominated environments and those, especially of long duration and high intensity, can be highly damaging and leave long-lasting effects. This book describes the climatic conditions that give rise to droughts, and their various forms and chief attributes. Past droughts are described including those that had severe impacts on human societies. As a disturbance, droughts can be thought of as “ramps” in that they usually build slowly and take time to become evident. As precipitation is reduced, flows from catchments into aquatic systems decline. As water declines in water bodies, ecological processes are changed and the biota can be drastically reduced, though species and populations may survive by using refuges. Recovery from drought varies in both rates and in degrees of completeness and may be a function of both refuge availability and connectivity. For the first time, this book reviews the available rather scattered literature on the impacts of drought on the flora, fauna and ecological processes of aquatic ecosystems ranging from small ponds to lakes and from streams to estuaries. The effects of drought on the biota of standing waters and flowing waters and of temporary waters and perennial systems are described and compared. In addition, the ways in which human activity can exacerbate droughts are outlined. In many parts of the world especially in the mid latitudes, global warming may result in increases in the duration and intensity of droughts. Drought and Aquatic Ecosystems is essential reading for freshwater ecologists, water resource managers and advanced students.

Scandal and Silence. Media Responses to Presidential Misconduct Scandal and Silence. Media Responses to Presidential Misconduct

This timely and engaging book challenges the conventional wisdom on media and scandal in the United States. The common view holds that media crave and actively pursue scandals whenever they sense corruption. Scandal and Silence argues for a different perspective. Using case studies from the period 1988-2008, it shows that: Media neglect most corruption, providing too little, not too much scandal coverage; Scandals arise from rational, controlled processes, not emotional frenzies – and when scandals happen, it’s not the media but governments and political parties that drive the process and any excesses that might occur; Significant scandals are indeed difficult for news organizations to initiate and harder for them to maintain and bring to appropriate closure; For these reasons cover-ups and lying often work, and truth remains essentially unrecorded, unremembered. Sometimes, bad behavior stimulates an avalanche of media attention with demonstrable political consequences, yet other times, equally shoddy activity receives little notice. This book advances a theoretical model to explain these differences, revealing an underlying logic to what might seem arbitrary and capricious journalism. Through case studies of the draft and military scandals involving Dan Quayle, George W. Bush, Bill Clinton and John Kerry; alleged sexual misconduct of politicians including but not limited to Clinton; and questionable financial dealings of Clinton and George W Bush, the book builds a new understanding of media scandals which will be essential reading for anyone concerned with the relationship between media and democracy today.
